Vandals caused over $850,000 in property destruction and other damage to a unit in a multi-family building on Washington’s coast. The owner submitted a vandalism and water damage claim to its property insurer, seeking the policy’s limit which would be required to completely repair all the property damage. Insurer offered $100,000 for “water damage” and denied the balance of the owner’s claim, citing a “theft exclusion” in the insurance policy. Greg Harper filed suit against the property insurer for breach of contract, bad faith, and violations of Washington’s Insurance Fair Conduct Act. Insurance company settled the lawsuit soon after it was filed for a seven figure amount in excess of the policy’s limit. As a result, client was made whole for all its losses.
