Harper│Hayes Obtains Multi-Million Dollar Settlement for Condominium Association Client on the Eve of Trial

In 2016, the President of the Board of a large condominium contacted the firm, initially inquiring whether insurance would cover water damage to 80,000 square feet of roof structure. Investigation revealed that the water intrusion was caused by the defective work of the roofing contractor that installed the roofing system three years prior.

Harper│Hayes made a construction defect claim against the roofing contractor. After attempts to resolve the claim without litigation failed, the firm filed a lawsuit against the contractor in January of 2017 seeking the costs to replace the defective roof and repair all the resulting water damage. After defeating the contractor’s legal arguments that the amount of any recovery should be severely limited, the Harper│Hayes team obtained a substantial settlement from the contractor’s insurers, allowing the Condominium Association to fix all the underlying water damage and replace the roof with a waterproof system. Yet another example of a creative solution for what initially seemed like an unsolvable problem.
